German Priest in Church Abuse Scandal Is Suspended

Rupert Frania, the priest in charge of the congregation in Bad Tölz, where Father Hullermann spent the last year and a half, said in an interview on Sunday that his superiors did not tell them about the priest’s history of sexual abuse.

The statement by the archdiocese said that there was “no evidence of recent sexual abuses, similar to those for which he was convicted in 1986.”

Significant questions remain unanswered, especially about the pope’s involvement during his time as archbishop and how closely he supervised decisions about the priest. Nor have any of the victims in Grafing as yet come forward publicly.
Even before this latest case, the European sexual-abuse scandal had deeply damaged the church’s reputation in the pope’s home country, Germany. U.S. Consular Aide and Husband Killed in Mexico

LA UNIÓN, Mexico — Gunmen believed to be linked to drug traffickers shot a pregnant American consulate worker and her husband to death in the violence-racked border town of Ciudad Juárez over the weekend, leaving their baby wailing in the back seat of their car, the authorities said Sunday. The shootings appeared to be the first deadly attacks on American officials and their families by Mexico’s powerful drug organizations. The shootings in Ciudad Juárez took place in broad daylight, within minutes of each other on Saturday as the victims were on their way home from a social gathering at another consulate worker’s home.
The first attack was reported at 2:32 p.m.
Jorge Alberto Salcido Ceniceros, 37, the husband of a consular worker, was found dead in a white Honda Pilot, with bullet wounds to his body, the authorities said. In the back seat were two wounded children, one aged 4 and one 7. They were taken to the hospital.
Shell casings from a variety of caliber weapons were found at the scene.
Another call came in 10 minutes later, several miles away. This time it was a Toyota RAV4 with Texas plates that had been shot up, with two dead adults inside and a baby crying from a car seat in the back. Mexican officials identified the couple as Lesley A. Enriquez, 25, a consulate employee, and her husband, Arthur H. Redelf, 30, from across the border in El Paso.
Ms. Enriquez, an American citizen, was shot in the head. Her husband was shot in neck and left arm. A 9 mm bullet casing was found at the scene.
Cmdr. Gomecindo López of the El Paso County Sheriff’s Department, who is acting as a spokesman for the family, said Ms. Enriquez was pregnant.

Trichet Sides With Advocates of Crackdown on Banks

One question, however, is how effective any rules would be if they applied only to Europe. Timothy F. Geithner, the Treasury secretary, complained about the proposed hedge fund rules Thursday to the European Union’s financial markets chief, Michel Barnier.
Mr. Trichet made his remarks at a gathering organized by the Stanford Institute for Economic Policy Research, which included several other prominent figures, including Lawrence H. Summers, director of the National Economic Council and a top adviser to President Obama; and Jamie Dimon, the chief executive of JPMorgan Chase.
Mr. Trichet has spoken in favor of more financial regulation in the past, but his remarks Friday seemed to take a harsher tone. And his comments may carry more weight because, as a cautious central banker who does not need to worry about re-election, he is less susceptible to charges of political populism.
Like the British and French leaders, Mr. Trichet seemed to take aim at hedge funds when he said: “Financial reform needs to go beyond the banking sector on which so much attention has been focused. We also have to look very closely at nonbank financial institutions and at the setup and functioning of financial markets.” Beyond suggesting that banks should be required to hold more capital in reserve, Mr. Trichet did not say specifically what changes were needed to prevent future financial crises.
But he mentioned credit-default swaps and other “complex financial instruments” that political leaders, including the German chancellor, Angela Merkel, have blamed for inflaming Greece’s already perilous finances.
The Greek prime minister, George A. Papandreou, also complained during a visit this week to Washington that speculators had driven up the interest rate the government must pay on its bonds.
Mr. Trichet has often lectured Greece on the need for better fiscal discipline, but he seemed to agree with Mr. Papandreou that derivatives could destabilize financial markets. “These were invented as instruments to repackage, disseminate and hedge risks,” Mr. Trichet said. “In fact, credit derivatives turned into potent vehicles for pure financial market participants to leverage their views.”
Mr. Trichet seemed to issue a warning to banks that have taken advantage of the huge amounts of cash that the European Central Bank has lent them at low rates. In some cases, banks have reinvested money borrowed at 1 percent in higher-yielding assets, earning millions of euros in easy profits.
“Banks might become dependent on today’s very favorable access to central bank refinancing to such an extent that their incentives to repair their balance sheets remain weak,” he said. The nearly unlimited money supplied by the central bank “opens the door to opportunistic bidding behavior.”

Ground Zero Workers Reach Deal Over Health Claims

A settlement of up to $657.5 million has been reached in the cases of thousands of rescue and cleanup workers at ground zero who sued the city over damage to their health, according to city officials and lawyers for the plaintiffs. Ed hardy jackets

Payouts to the plaintiffs would come out of a federally financed insurance company with funds of about $1.1 billion that insures the city. At least 95 percent of the plaintiffs must accept its terms for it to take effect. If 100 percent of the plaintiffs agree to the terms, the total settlement would be $657.5 million. Under the settlement, a claims administrator, who will be chosen by the lawyers in the case, would decide whether a given plaintiff had a valid claim, whether the plaintiff qualified for compensation and if so, for how much. The system is similar to the one used for payouts from the Sept. 11 Victim Compensation Fund to families of those killed in the terrorist attacks. Since 2003, thousands of firefighters, police officers, construction workers and emergency responders have filed lawsuits against 90 defendants — including the city and the private companies it hired to remove debris at ground zero — over illnesses they say developed after they spent days, weeks or months working at the World Trade Center site after the attacks.
The plaintiffs claimed that their conditions — most commonly asthma and other respiratory illnesses — resulted from the toxic brew of contaminants at ground zero and the defendants’ failure to adequately supervise and protect them with safety equipment, like respirators. Among the first cases chosen for trial was that of a 47-year-old firefighter, Raymond W. Hauber, who died of esophageal cancer in 2007 before his case could be heard.
Some of the cases that fall under the settlement involve plaintiffs who are not ill now, but fear they will develop illnesses like cancer that can take years to manifest themselves. The settlement provides for a $23.4 million insurance policy to cover future claims by such plaintiffs.
The first 12 cases were scheduled to come to trial on May 16 in Manhattan, and those trials will now not take place. But under the settlement, plaintiffs have 90 days to opt out of the settlement and pursue trials.
Lawyers for the plaintiffs would collect a third of the settlement amounts in legal fees. The insurance company, known as W.T.C. Captive Insurance and financed by the Federal Emergency Management Agency, has already paid out more than $200 million in legal fees to defend the city and its contractors and in administrative costs.
To determine individual settlement amounts, the administrator will use a point system to determine the severity of a plaintiff’s illness, as documented by medical history. Other factors that will be considered include evidence of a link to ground zero and adjustments for age, pre-existing conditions, time of diagnosis, smoking history and length of time spent at ground zero. The process could take up to a year.
Mindful of the intense public interest in the cases, Judge Hellerstein has told lawyers on both sides that he planned to review each settlement and hold “fairness” hearings to determine whether the settlements were reasonable, which legal experts said was unusual for litigation not involving a class action.
“Many of them are similar, but in fundamental aspects they have an individual plaintiff — they all revolve around one person,” Judge Hellerstein told the lawyers at a Jan. 21 hearing. “I’ll be looking carefully, if there is a settlement, at how individual members are treated.”
The city argued that it was immune from damages in cases involving a national emergency or a civil defense disaster. Lawyers for the city also questioned the connection between the illnesses and exposure at ground zero and cast doubt on many of the claims themselves, for example, arguing in the case of a mechanic for Consolidated Edison, which was also to be among the first trials, that the man’s lung and respiratory problems predated 9/11.

House Leaders Bar Earmarks to For-Profit Companies

Half of Food Aid to Somalia Is Diverted, Report Says

In addition to the diversion of food aid, regional Somali authorities are collaborating with pirates who hijack ships along the lawless coast, the report says, and Somali government ministers have auctioned off diplomatic visas for trips to Europe to the highest bidder, some of whom may have been pirates or insurgents. “Some humanitarian resources, notably food aid, have been diverted to military uses,” the report said. “A handful of Somali contractors for aid agencies have formed a cartel and become important power brokers — some of whom channel their profits — or the aid itself — directly to armed opposition groups.”
These allegations of food aid diversions first surfaced last year, and the World Food Program has consistently denied finding any proof of malfeasance and said that its own recent internal audit found no widespread abuse.
“We have not yet seen the U.N. Somalia Monitoring Group report,” the World Food Program’s Deputy Executive Director, Amir Abdulla, said Tuesday. “But we will investigate all of the allegations as we have always done in the past if questions have been raised about our operations.”
The current report’s investigators question how independent that past audit was, and called for an new outside investigation of the United Nations agency.
“We have to tell these folks that you cannot go on like this, we know what you are doing, you can’t fool us anymore, so you better stop,” said President Ali Bongo Ondimba of Gabon, who was at the United Nations, where his country holds the reins of the Security Council this month.
The report also charges that Somali officials are selling spots on trips to Europe and that many of the people who are presented as part of an official government entourage are actually pirates or members of militant groups.
The report says that Somali officials use their connections to foreign governments to get visas and travel documents for people who would not otherwise be able to travel abroad and that many of these people then disappear into Europe and do not come back.
“Somali ministers, members of parliament, diplomats and ‘freelance brokers’ have transformed access to foreign visas into a growth industry, matched possibly only by piracy, selling visas for $10-15,000 each,” the report said.
The reports’ authors estimate that dozens, if not hundreds, of Somalis have gained access to Europe or beyond through this under-the-table visa business.

Death Toll From Nigeria Violence Hits 500

DAKAR, Senegal — Officials and human rights groups in Nigeria sharply increased the count of the dead after a weekend of vicious ethnic violence, saying Monday that as many as 500 people — many of them women and children — may have been killed near the city of Jos, long a center of tensions between Christians and Muslims. The dead were Christians and members of an ethnic group that had been feuding with the Hausa-Fulani, Muslim herders whom witnesses and police officials identified as the attackers. A few miles south of the city nearly 400 of the victims were buried in a mass grave in Dogon Na Hauwa, the village where the worst violence occurred. Some of the bodies had been mutilated.
There, women cried unconsolably amid crowds of mourners, and the smell of burned and decomposing flesh hung in the air. Officials combed a large area around the village, continuing to find bodies during the day.
Shehu Sani, president of Civil Rights Congress, said in a phone interview on Monday that members of his group counted 492 bodies, mainly in Dogon Na Hauwa. He said that security forces had not been much in evidence in the “vulnerable areas” south of Jos. Mr. Sani said that the attackers were motivated at least in part by a large theft of cattle by members of the same Christian ethnic group as the victims.
“We were at the scene of the violence,” Mr. Sani said, suggesting that the local government figure of 500 was not an exaggeration.
“We have counted as many bodies as that,” he said. “There are not enough functional mortuaries to take them. It’s possibly even more than that because many were buried without documentation.”

Since last Friday, 29 House Democrats have given back or donated to charity more than $400,000 in contributions from Mr. Rangel’s three political fund-raising committees. Ms. Pelosi dismissed the criticism on Thursday that Democrats had not lived up to their promise to sweep away a culture of corruption on Capitol Hill. She also noted that she had established an outside group to receive complaints about members of Congress, which could be easily referred to the House ethics committee.
“My commitment to the American people is that the public trust will always be honored,” Ms. Pelosi said at her weekly news conference. “And on the floor of the House, that happens.”
President Obama, who built his campaign around a pledge to change the way Washington works and to strengthen transparency and ethics, has followed a practice of generally not commenting on the scandals or allegations involving the Democratic politicians. Months ago, several of his senior advisers worked behind the scenes to try to dissuade Governor Paterson from running for election, a pitch that failed.
Last week, Mr. Paterson conceded that he would not be on the ticket in the fall, but he has declined to step down. The White House has said that it has no intention of wading into the Paterson situation again, but several advisers said they were following the developments with interest.
It is the case of another governor, perhaps, that has drawn even more attention from those inside the West Wing.
Mr. Blagojevich, who was impeached last year as the governor of Illinois, faces a criminal trial in June. The proceedings are expected to be unfolding at the very moment that Democrats are battling in several races, including a campaign for the Senate seat once held by the man who now sits in the Oval Office.

Obama Offers to Use Some G.O.P. Health Care Proposals

In the letter, he said Democrats and Republicans agreed about the need to fix the health care system, even if they disagreed on the remedies, and he seemed to be trying to build on the public display of bipartisanship at last week’s meeting and to blunt Republican criticism that Democrats are pursuing a partisan bill. “My ideas have been informed by discussions with Republicans and Democrats, doctors and nurses, health care experts and everyday Americans — not just last Thursday, but over the course of a yearlong dialogue,” Mr. Obama wrote. “Both parties agree that the health care status quo is unsustainable. Republicans said they welcomed the president’s interest in their ideas, but said it was a meaningless gesture if Democrats remained intent on pushing through expansive, and expensive, legislation, which the Republicans assert would unwisely raise taxes and reduce federal spending on Medicare.
Mr. Coburn, in a statement, said Democratic leaders could continue to work with Republicans on areas of agreement — “or they can attempt an all-or-nothing reconciliation strategy based on the deeply flawed Senate and House bills and most likely accomplish nothing.”
Mr. McConnell, at a news conference, cited the Republican victory in the Massachusetts special Senate election in January as an example of what could happen to Democrats if they succeed in adopting sweeping health care legislation “over the objections of the American people.”
The bills passed by the House and the Senate would expand Medicaid to cover some 15 million people who are now uninsured. But in most states, payment rates are so low that many doctors do not accept Medicaid patients, a point that Senator Charles E. Grassley, Republican of Iowa, raised at the forum on Thursday.
“There’s no question Medicaid won’t be able to provide adequate access,” Mr. Grassley said in response to Mr. Obama’s letter. “It’s good if the White House has figured that out.”
Higher Medicaid payment rates could substantially raise the cost of the bill, even as Democratic leaders try to hold down the price tag to secure the support of fiscal conservatives in their own party.
As they begin a final push to round up votes, Democrats are also struggling to figure out how to orchestrate the intricate legislative maneuvers that will be needed to complete their bill.
Under the tentative plan, they said, the House would adopt the bill passed by the Senate on Dec. 24, and both chambers would approve a package of revisions in a separate budget reconciliation bill. The changes would bridge differences between the House and the Senate and incorporate some of Mr. Obama’s proposals.
Senator Kent Conrad, Democrat of North Dakota and chairman of the Budget Committee, said it might be possible to use the reconciliation procedure for “a set of relatively minor matters that have a budget impact.”
Coordinating the work of the two chambers could be “extraordinarily complicated,” he said.
In addition, the budget reconciliation process could be time-consuming in the Senate, where Republicans said they would raise procedural objections and offer numerous amendments.
Mr. Conrad said the budget bill might be used to “increase the affordability” of health insurance, by increasing subsidies for some people, and to increase federal payments to states for people newly eligible for Medicaid.
But to comply with reconciliation requirements, Mr. Conrad said, the budget bill would have to reduce the deficit over the next five years, taken together, and must not increase the deficit in any year thereafter.
The budget bill could probably not be used to establish restrictions on insurance coverage of abortion, an issue that deeply divides the House and the Senate, Mr. Conrad said.
Senator Olympia J. Snowe, Republican of Maine, said she was not impressed by the concessions Mr. Obama offered in his letter. “It’s always welcome, inserting Republican ideas,” Ms. Snowe said. “But it does not ameliorate other issues. The basic legislation is not going to change. That continues to be troubling.”

Hopes for Senate Seat Open Rifts in California G.O.P.

BURBANK, Calif. — If Republicans are to have a serious chance of capturing control of the Senate in November, they are going to have to win in traditionally Democratic states like California, where Senator Barbara Boxer, a three-term Democrat, is showing signs of vulnerability. Ed hardy clothes
But before Republicans get a clear shot at Mrs. Boxer, they will have to overcome deep divisions within their own party — divides that reflect both the grass-roots energy surging through the conservative movement and the tensions between the party’s moderate and conservative wings. There are certainly more vulnerable Democratic Senate seats in the country, but early polls in California suggest that Mrs. Boxer is facing what could be the toughest election of her career. It is hard to see how Republicans can win control of the Senate without toppling Mrs. Boxer. Democrats control the chamber 59 to 41; Republicans need 10 seats to take control, since in an evenly divided Senate, Vice President Joseph R. Biden Jr. would cast the tie-breaking vote in favor of the Democrats. Eight Democratic seats are considered vulnerable, but Republicans must hold on to at least four of their own seats that appear vulnerable. John J. Pitney Jr., a political science professor at Claremont McKenna College, said Mrs. Boxer’s previous easy victories in Senate races could be misleading, since they took place in what were more favorable political environments. “She may be more vulnerable than it seems at first,” Professor Pitney said. Democrats fear that a Supreme Court decision allowing corporations to spend freely on political campaigns could encourage a flood of advertising against Mrs. Boxer.
She is clearly aware of the threat to her re-election and has moved forcefully to deal with it. She has already raised nearly $11 million.
“If you’re asking me if Republicans have a chance to beat me, I’m going to answer this way: I never take any election for granted,” Mrs. Boxer said in an interview. “It is a tough year. I am going to focus; I am going to work my heart out.”
Mr. Campbell is a self-described fiscal conservative who supports abortion rights and same-sex marriage. “He would have more appeal to moderate voters than any other Republican nominee — other than Arnold or Pete Wilson — has had here for the past 25 or 30 years,” said Bill Carrick, a longtime Democratic consultant in the state, referring to Gov. Arnold Schwarzenegger and Mr. Wilson, the former California governor.
But the positions that might help Mr. Campbell in a general election are a burden in the Republican primary. And the hurdle is not only on social issues. When Mr. Campbell was finance director for Governor Schwarzenegger, he supported temporary tax increases to deal with the state’s worsening fiscal crisis, and Ms. Fiorina and Mr. DeVore have criticized him for that.
“Tom Campbell has a distinctly different point of view than I do,” Ms. Fiorina said. “He believes the way to close budget deficits is to raise taxes. I think that’s the wrong approach.”
Mr. Campbell has also come under attack from his rivals for his ties to a professor who aided Palestinian militants and for being, by their account, insufficiently supportive of Israel. Mr. Campbell has said that he was unaware of the professor’s activities and that he supports Israel.
Mr. Campbell suggested that Ms. Fiorina and Mr. DeVore may split the conservative vote in the June 8 primary, allowing him to slip through. He has also said some conservatives might overlook their differences with him in their hunger to oust Mrs. Boxer.
“She is particularly vulnerable to me,” Mr. Campbell said in an interview. “I’m pro-choice. It’s going to be the first time she’s ever had to run against a candidate with my profile. It’s a huge advantage for me.”
Ms. Fiorina was at one point viewed by Republicans as a formidable candidate because of her wealth (she has put $2.5 million into her campaign) and a compelling personal story: she rose from receptionist to chief executive and is also a breast cancer survivor.
But she has not had an easy transition from business executive to candidate. Ms. Fiorina suggested the other day that California file for bankruptcy; that is legally not possible. Her campaign produced a widely ridiculed Internet attack video portraying the mild-mannered Mr. Campbell as a wolf, with glowing red eyes, in sheep’s clothing. (The point was that he was not really a fiscal conservative.) Mr. DeVore has been unsparing in his attacks on her.
“She has some personal wealth — but she was fired from Hewett-Packard,” he said. “She only voted six times in her life. She has a condo in Georgetown at the Ritz-Carlton that is 13,000 square feet bigger than my house — and she confessed she got it with the golden parachute money she got when she was fired. These sort of flaws will be played up significantly by Boxer.”
Mr. DeVore may be the wild care in the race. He has won the backing of an influential conservative political action committee created by Senator Jim DeMint, Republican of South Carolina. And his candidacy will offer a test of the strength of the Tea Party movement in this state. A poll taken in California in January found that 70 percent of Republicans had heard of the Tea Party movement, with 52 percent of them identifying with its ideas somewhat or “a lot.”
But Mr. DeVore, who is known as Chuck, is struggling to raise money, and remains barely known by most Californians. He said he hoped that as his profile rose, he would draw a wave of Tea Party contributions from across the country.
“This is eminently winnable for all three Republicans,” Mr. DeVore said of the Boxer race, “but I would argue, counterintuitively, that I am the most dangerous threat. Because I am the guy who is the toast of the Tea Partiers.”
